05.12.2022 Sl.91 Ct. No.1 SD CALCUTTA HIGH COURT In the Circuit Bench at Jalpaiguri CRM (A) 675 of 2022 In re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed in connection with Bhaktinagar Police Station Case No.1021 of 2022 dated 20.9.2022 under Section 341/325/506/376/34 of the Indian Penal Code;

And In re: Sri Bikash Singh @ Bikash Roy ... petitioner.

Ms. Sriya Basu ... for the petitioner.

Mr. Arun Kumar Sarkar Mr. Sourav Ganguly ...for the State.

Heard the learned counsel for the petitioner as well as the learned Public Prosecutor.

Perused the case diary and perused the statement of the victim recorded under Section 164 of the Code of Criminal Procedure. On perusal of the case diary, it appears that the present petitioner is implicated in another case on the same allegation by the same victim. This is a second allegation and strong incriminating elements are there against the present petitioner and it is alleged that he is threatening the victim girl. Therefore, considering the seriousness of offence, we are not inclined to allow the application for anticipatory bail.

Accordingly, CRM (A) 675 of 2022 is dismissed. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
