This appeal is directed against an order dated 30th September, 2024 passed by an Hon'ble Single Judge of this Court in WPA 1944 of 2024 thereby directing the Commissioner of Police, Siliguri to forthwith initiate major penalty, disciplinary proceedings and departmental proceedings after conducting the preliminary enquiry against the ASI Asit Saha and the concerned Inspector-in-Charge, Bhaktinagar Police Station in FIR No.450 of 2022 dated 4th May, 2022.

A further direction was also passed by the order impugned for a report to be placed before the Hon'ble Single Judge by the District Judge Jalpaiguri disclosing compliance with the order dated 19th August, 2024 passed by a coordinate Bench of this

Court in MAT 26 of 2023 along with IA No.CAN 1 of 2023.

It is submitted by the parties before this Court that the aforesaid order dated 30th September, 2024 had been passed effectively directing compliance with the order dated 19th August, 2024 passed by a coordinate Bench of this Court in MAT 26 of 2023 along applications, however, the order dated 19th August, 2024 was subsequently reviewed and recalled by the coordinate Bench by an order dated 22nd January, 2025 in RVW 12 of 2024 along with CAN 1 of 2024.

Since the very basis of the order dated 30th September, 2024 no longer remains upon the order dated 19th August, 2024 passed in MAT 26 of 2023 along with CAN 1 of 2023 being recalled in review, the present appeal and the connected application, as has been correctly pointed out by the learned advocate appearing for the respective parties, has become infructuous.

Accordingly, MAT 97 of 2024 along with CAN 1 of 2024 are dismissed as having become infructuous. (Rajasekhar Mantha, J.) (Om Narayan Rai, J.)
