For the respondent no.4 The writ petition is directed against an order dated July 21, 2023 passed by th West Bengal Land Reforms and Tenancy Tribunal.
An application for mutation was made before the concerned Block Land and Land Reforms Officer (B.L. & L.R.O.). It was made at the behest of the private respondent no.4 appearing before us.
The application was initially rejected. An appeal was preferred by the appearing private respondent no.4 before the District Land and Land
Reforms Officer (D.L. & L.R.O.) as the appellate authority. The D.L. & L.R.O. set aside the order of the B.L. & L.R.O and directed fresh consideration of the application for mutation.
The writ petitioner before us approached the Tribunal assailing the order of the D.L. & L.R.O. by way of O.A. 2095 of 2023 in which the impugned order dated July 21, 2023 was passed.
During the pendency of the writ petition, the B.L. & L.R.O. passed fresh order allowing the mutation of the name of the private respondent no.4 appearing before us.
The Court is informed that, an appeal was preferred against the fresh order of the B.L. & L.R.O. by the writ petitioner.
In such circumstances, nothing survives in the present writ petition.
W.P.L.R.T. 3 of 2023 is disposed of without any order as to costs.
It is clarified that, none of the observations made herein or in the impugned order will affect the rights of any of the parties in the pending appeal. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
