Md.Abdul Hannan @ Md. Abdul Hasan And ANR v. The State Of West Bengal
02.04.2025 Item no. 57.
Court No.1.
AB Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (A) 819 of 2024 With CRAN 2 of 2025 In Re: An Application for Relaxation of condition of Anticipatory Bail And In the matter of : Md. Abdul Hannan @ Md. Abdul Hasnan & Anr.
......Petitioners.
Mr. Ananda Paul ......for the Petitioners.
Mr. A. S. Chakraborty, ld. APP Mr. Biswaroop Roy......for the State.
In re : CRAN 2 of 2025 1.
By an order dated November 13, 2024, the petitioners were granted anticipatory bail, inter alia, on the condition that they will furnish bonds of Rs.10,000/- each with two sureties of like amount each, one of whom must be local.
2.
The petitioners say that they have tried very hard but have not been able to find local surety. One of the reasons for that is that they are financially extremely weak. They pray for relaxation of the conditions of bail by permitting them to furnish registered surety instead of local surety.
3.
Learned State Counsel, in his usual fairness, leaves the matter to the discretion of the Court.
4.
I have considered the facts and circumstances of the case. The petitioners have not been able to take advantage of the order granting anticipatory bail for more than four months as they say that they have not been able to find local surety.
5.
For the ends of justice and taking a lenient view, I allow the petitioners' prayer and permit them to furnish registered surety instead local surety as a condition of anticipatory bail. The petitioners must comply with the condition within four weeks from date.
6.
The other conditions mentioned in the order dated 13.11.2024 remain unaltered.
7.
CRAN 2 of 2025 stands disposed of.
8.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Arijit Banerjee, J.)
