The application for anticipatory bail is made on the ground that the clash between the petitioner and the de facto complainants, who belonged to rival political parties, is a result of a local disagreement on an issue. Injuries have been sustained in this scuffled by both sides.

Learned counsel for the State opposes the prayer for anticipatory bail.

Having considered the materials on record including the case diary and scrutinizing the medical reports and the statements recorded under section 161 of the CrPC, this Court is inclined to grant anticipatory bail to the petitioner. 4.
In the event of arrest, the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/- with two sureties of
like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall cooperate with the investigation and on further condition that the petitioner shall not leave the jurisdiction of the Kotwali Police Station, district Cooch Behar until further orders and on further condition that the petitioner shall appear before the court below and pray for regular bail within a fortnight from date. 5.
In the event the petitioner fails to comply with the aforesaid conditions as enshrined hereinabove, the bail of the petitioner shall automatically stand cancelled without any further reference to this Court.
