IN THE CIRCUIT BENCH AT JALPAIGURI
WPA 2936 of 2022 Subrata Singha Vs.
The State of West Bengal and Ors.
Mr. Debabrata Dhar Mr. Prodyot Kumar Roy ... For the Petitioner.
The petitioner complains that no offence is being made out against him in Birpara Police Station Case No.163 of 2022 dated 12th October 2022 and yet he is named accused. The FIR is under Sections 21(C)/25/29 of the N.D.P.S. Act. The petitioner submits that he is the owner of the vehicle and had no knowledge of the contraband being transported. The petitioner seeks protection against arrest. Given the alternative remedy available to him for bail and/or anticipatory bail and for seeking return of vehicle under the Cr.P.C., this Court is not inclined to entertain the writ petition.
With the aforesaid observations, the writ petition is disposed of without any order.
There shall be no order as to costs.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rajasekhar Mantha, J.)
