Court No.01.

S. De (Rejected) Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (A) No. 831 of 2024 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 corresponding to Section 438 of the Code of Criminal Procedure. And In the matter of: Raja Miah @ Raja Mia @ Azahar Miah. ......Petitioner.

Mr. Sandip Guha Roy, ......for the Petitioner. Mr. Aditi Shankar Chakraborty, Ld. APP, Dr. Arjun Chowdhury, ......for the State.

Dictated by Biswaroop Chowdhury, J.

1. Learned advocate for the petitioner and learned advocate for the opposite party/State of West Bengal are present.

2. Heard learned advocates for both the parties.

3. Learned advocate for the petitioner submits that his client is renewing the prayer for anticipatory bail which was earlier rejected on May 22 of 2024 in CRM (A) 417 of 2024.

4. Learned advocate for the opposite party objects the grant of bail. He submits that the present petitioner was absconding for a long period of time and hence, his prayer for bail may not be considered.

5. Upon considering the facts of the case and the fact that the prayer for anticipatory bail was earlier rejected by this Court and

also the fact that the petitioner has not been able to bring out any new circumstance for further consideration of the anticipatory bail, we are of the view that there is no scope to allow the prayer for bail of the petitioner.

6. Thus, prayer for anticipatory bail made by the petitioner is rejected.

7. CRM (A) 831 of 2024 is dismissed.

8. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Biswaroop Chowdhury, J.) (Arijit Banerjee, J.)
