Mr. Guha, learned advocate appearing for the petitioner submits that the petitioner is at an advance stage of pregnancy of about eight months. She has been falsely implicated in the alleged incident. No specific overt act has been attributed to the petitioner. There is also no possibility that she would flee from justice. In the said conspectus, custodial interrogation of the petitioner may not be necessary more so when upon completion of investigation chargesheet has been filed. During investigation other co-accused persons have already been enlarged on bail by the learned Sessions Judge.

Mr. Biswas, learned advocate appearing for the State opposes Mr. Guha's prayer and submits that there are strong

incriminating materials against the petitioner and in support of such contention he has drawn the attention of this Court to the statements of the witnesses and the injury report. Having heard the learned advocates and considering the materials in the case diary including the statements of the witnesses, the extent of complicity of the petitioner in the alleged offence and the fact that she is at an advance stage of pregnancy, I am of the opinion that her custodial interrogation is not necessary moreso when prima facie, it does not appear that she would flee from justice and as upon completion of investigation chargesheet has been filed.

Accordingly, I direct that in the event of arrest the petitioner, namely, Lila Oraon shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

The application for anticipatory bail, being CRM (A) 809 of 2025, is disposed of.
