IN THE HIGH COURT AT CALCUTTA

Item No.24 CIRCUIT BENCH AT JALPAIGURI Ct.No.2 CRIMINAL REVISIONAL JURISDICTION dc.

C.R.R. 255 of 2023 In the matter of : Nima Lama ... Petitioner.

Ms. Madhushri Dutta ... For the Petitioner.

Mr. A. S. Chakraborty, Mr. Ujjwal Luksom ... For the State.

Learned advocate appearing for the petitioner is directed to serve copy of this revisional application upon Mr. Ujjwal Luksom, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

The subject-matter of challenge relates to the proceedings arising out of Pradhan Nagar Police Station Case No. 380 of 2023 dated 24.05.2023 under Sections 4/5/7/9 of Immoral Traffic (Prevention) Act including the orders passed therein.

The petitioner has approached this Court at the investigation stage. The main thrust of contention is that the petitioner's name surfaced on the basis of statement of coaccused and there are no materials so far as the present petitioner is concerned.

I have considered the submissions advanced by the learned advocate appearing for the petitioner and on an assessment of the same, I find that at this stage when the

investigation is under progress, it would not be fit and proper to interfere with the contentions advanced by the petitioner. The petitioner would be at liberty to approach this Court at the appropriate stage and/or if required, he has document in his possession to place the same before the investigating officer to prove his innocence. With the aforesaid observations, the revisional application being CRR 255 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
