For the State The records of the present revisional application reflect that the petitioner approached this Court immediately after submission of the charge-sheet. The documents under Section 207 of the Cr.P.C. are yet to be supplied to the petitioners or the other accused persons, who have been implicated in connection with the instant case. The petitioner is directed to serve a copy of this revisisonal application upon Mr. Aniruddha Biswas, ld. Advocate, who ordinarily appears on behalf of the State. His appearance may be reglarised by the concerned authority.

Having considered the factual circumstances and that only the FIR and the report under Section 173 of the Cr.P.C. has been enclosed along with the present revisional application, I am of the view that the revisional application, so preferred, is premature and, as such, no interference is made at this stage.

However, the petitioner would be at liberty to approach this Court after receipt of the document under Section 207 of the Cr.P.C. In the alternative, the petitioner will also be at liberty to approach the trial court under section 227 of the Cr.P.C. after receipt of the document under Section 207 of the Cr.P.C.

In case, such application is taken out, then, the ld. Trial Court will dispose of the same in accordance with law without being influenced by any of the observations made by this court while dealing with the present revisional application. With the aforesaid observations, CRR 257 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties shall act on the server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
