Case No.345 of dated 05.09.2025 under Sections 109(1)/115(2)/117(2)/329(4)/351(3)/49/74, corresponding to PTN Case No.5587 of 2025, pending before the leaned Chief Judicial Magistrate at Jalpaiguri.

Learned Advocate for the petitioner submits that there are long standing disputes between the parties. The victim did not sustain any grievous injuries. The co-accused has been granted anticipatory bail by the learned Sessions Judge, Jalpaiguri. He seeks for grant of anticipatory bail in favour of the petitioner.

Opposing such prayer for anticipatory bail, learned Advocate for the State submits that the victim sustained injuries and had to be hospitalized. He seeks for dismissal of the application for grant of anticipatory bail.

Perused the case diary and the materials on record. 4.

Although there are allegations against this petitioner of assaulting the victim on the date of incident, however, the injury report shows that the victim was discharged after one day. There is no noting as to whether the injury is grievous or not. Considering the above, I am inclined to allow the prayer of the petitioner for anticipatory bail. 5.

Accordingly, in the event of arrest the petitioner namely Sajit Roy @ Sanjit Roy shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, corresponding to 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and shall meet the Investigating Officer of the concerned police station once in a fortnight until further orders and shall attend the Court on the dates fixed for appearance and hearing. The petitioner is directed to join investigation and cooperate with the Investigating Officer.

In case the petitioner fails to adhere to any of the conditions mentioned in Section 438(2) of the Code/ Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023, the learned trial Court shall be entitled to cancel the anticipatory bail without further reference to this Court. 7.

This application for anticipatory bail is, thus, allowed.

CRM (A) 827 of 2025 stands disposed of.
