Obaidullah, Ms. Ankita Dey, Mr. Nikchen Tamang ...for the Petitioner Mr. Aditi Shankar Chakraborty, APP, Mr. Aniruddha Biswas, ...for the State Leave is granted to the learned advocate-on-record of the petitioner to correct the cause title of the present application considering the averments made in the supplementary affidavit. Apprehending arrest in connection with Sitai Police Station Case No.242 of 2025 dated 09.10.2025 under Sections 103/3(5) of the Bharatiya Nyaya Sanhita, 2023, the present application has been preferred.
Mr. Obaidullah, learned advocate appearing for the petitioner submits that no specific overt act has been attributed to the petitioner and he has been falsely implicated. One coaccused similarly situated has already been granted anticipatory bail by the learned Sessions Court on 11th November, 2025. In
the said conspectus, custodial interrogation of the petitioner may not be necessary.
Mr. Biswas, learned advocate appearing for the State submits that upon completion of investigation a final report being Sitai P.S. FRMF No.281 dated 30.11.2025 has been filed. In view of such submission of Mr. Biswas as there is no apprehension of arrest of the petitioner, the application being CRM (A) 828 of 2025 is dismissed.
