1. The petitioner says that he is in custody for 224 days. The seizure of contraband items was not from his possession. It was from the locality where he resides. Charge is yet to be framed. He prays for bail.
2. Opposing the prayer for bail learned State Advocate says that November 14, 2024, has been fixed as the date for consideration of charge. Approximately 27 Kgs. of ganja was recovered from the exclusive possession of this petitioner as would appear from the seizure list.
3. We have considered the material on record. Given the prima facie involvement of the petitioner and that commercial quantity of contraband items being involved, keeping in mind the restrictions in Section 37 of the NDPS Act, 1985, we are
not inclined to allow the petitioner's prayer for bail, at this stage. Hence the prayer for bail is rejected.
4. The application being CRM (NDPS) 480 of 2024 is accordingly dismissed.
