Learned advocate appearing for the petitioner, in his usual fairness, submits that the petitioner has approached the Writ Court as the State Administrative Tribunal is not functional at the present moment.
Such submission is not opposed by the learned advocate appearing for the State.
Since there is no alternative, efficacious remedy which the petitioner can avail at the present
moment, this court is inclined to entertain this writ petition.
The petitioner has submitted a representation before the Executive Engineer, Jalpaiguri Division, Public Health Engineering Directorate praying for disbursing the amount on account of balance Leave Salary after recomputing the Leave Statement. Learned advocate appearing for the petitioner submits though a representation dated April 24, 2025 was submitted, yet till date no decision on such representation has been communicated to the petitioner.
Learned advocate appearing for the State submits that if some time is granted, the State respondent shall communicate the decision to the petitioner.
In the light of the submissions made by the learned advocates for the respective parties, this writ petition stands disposed of without entering into the merits of the claim made by the petitioner in the representation dated April 24, 2025 and by directing the Executive Engineer, Jalpaiguri Division, Public Health Engineering Department, being the 4th respondent, to consider the representation of the petitioner dated April 24, 2025
which is annexed at page 28 of the writ petition and to dispose of the same by passing a reasoned order in accordance with law after affording an opportunity of hearing to the petitioner or her authorized representative and to communicate the reasoned order to the petitioner immediately thereafter. The entire exercise shall be completed by the State respondents within six weeks from the date of communication of a server copy of this order along with a copy of the representation dated April 24, 2025.
