Alok Roy v. The State Of West Bengal And ORS.
17.11.2023 Sl. No.46 srm
IN THE HIGH COURT AT CALCUTTA
CIRCUIT BENCH AT JALPAIGURI APPELLATE SIDE W.P.A. No. 2176 of 2023 Alok Roy Vs.
The State of West Bengal & Ors.
Mr. Supdipto Mazumder, Mr. Shubhankar Dutta ....for the Petitioner.
Mr. Subir Kumar Saha, Ms. Bedashruti Bose .....for State-respondents.
Mr. Bikramaditya Ghosh ....for the W.B. Central School Service Commission.
The petitioner is serving as an Assistant Teacher at Bamanhat High School, Coochbehar. On medical grounds, the petitioner applied for transfer to any school within the jurisdiction of Jalpaiguri. The petitioner applied through Utshasree portal which was operational at the relevant point of time. The case of the petitioner was forwarded to the concerned authorities and a medical examination was held at the instance of the Chief Medical Officer of Health, Coochbehar.
It is submitted that after the medical examination, the fate of the medical examination or the fate of the application for transfer was not intimated to the petitioner. The petitioner is in the dark. The petitioner contends that the matter is now pending before the West Bengal Central School Service Commission. The petitioner has relied on several documents in support of such contention.
Under such circumstances, the writ petition is disposed of with a direction upon the competent authority of the West Bengal Central School Service Commission to take a decision on the application for transfer filed by the petitioner, as discussed hereinabove. Such decision shall be taken and communicated within a period of two months from the date of communication of this order. The writ petition is, thus, disposed of.
There shall be no order as to costs.
Parties are directed to act on the basis of the server copy of this order.
