Case No. 344/2025 dated 15.07.2015 under Sections 329(4)/64 of the BNSS.

1. The bail prayer of the petitioner is taken up for consideration.

2. It is submitted by learned counsel for the petitioner that the petitioner has been in custody for 137 days. The investigation of the case has already ended in charge-sheet against the petitioner. There is no chance of absconsion of the petitioner being released on bail.

3. Learned counsel for the State refers to various materials in the case diary including the statement of the victim recorded under Section 183 of the BNSS as well as medical examination report of the victim.

4. Learned counsel for the de-facto complainant also opposes the prayer for bail.

5. It transpires from the materials on record that the petitioner is alleged to have committed rape upon the victim after entering into her house. The statement of victim recorded under Section 183 of the BNSS places the petitioner at the place of occurrence at the relevant point of time. Medical examination report which was prepared contemporaneously, speaks of the history of the alleged incident as reported by the victim.

6. Under such circumstances, considering the aforesaid materials on record and also in consideration of the gravity of offence, I am not inclined the petitioner to be enlarged on bail.

7. Hence, the prayer for bail of the petitioner is rejected.

8. Accordingly, CRM(M) 328 of 2025 stands disposed of. (Md. Shabbar Rashidi, J.)
