Circuit Bench at Jalpaiguri CRIMINAL MISCELLANEOUS JURISDICTION , CRM (A) 839 of 2025 In Re:- An application for anticipatory bail under Section 482 of BNSS in connection with Matigara Police Station Case No.406 of 2025 dated 23.06.2025 under Sections 123/115(2)/118(1)/74/ 76/351(2) and 3(5) of the Bhartiya Nyaya Sanhita, 2023 corresponding to PTN Case No.3458 of 2025 pending before the learned Additional Chief Judicial Magistrate at Siliguri. In the matter of : Gunjan Singh @ Gunjan Kumar Singh ... Petitioner.

Learned Advocate for the petitioner submits that the petitioner has been falsely implicated in this case. The victim did not sustain any grievous injury. The other coaccused have been granted anticipatory bail by the learned Sessions Judge. He seeks for grant of anticipatory bail to the petitioner.

Learned Advocate for the State opposes such prayer of anticipatory bail.

Perused the case diary and the materials on record. 4.

Although there are allegations against the petitioner of assaulting the victim on the date of incident, however,

there are no such notable injuries save and except swelling, bruise and abrasion. Considering the above, I am inclined to grant the prayer of the petitioner for anticipatory bail.

Accordingly, in the event of arrest the petitioner namely, Gunjan Singh @ Gunjan Kumar Singh shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of BNSS and shall meet the Investigating Officer once in a fortnight, until further order. The petitioner shall attend the court on the date fixed for appearance. The petitioner is directed to join investigation and cooperate with the Investigating Officer. 6.

In default the jurisdictional Court shall pass appropriate order to secure the presence of the petitioner in Court including cancelling the anticipatory bail granted without further reference to this Court.

This application for anticipatory bail is allowed. 8.

CRM (A) 839 of 2025 is, thus, disposed of.
