AT JALPAIGURI 17.12.2025 Court No.01 Item No.03 Avijit Mitra CRM (A) 840 of 2025 In Re:- An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023; And In Re: Moktar Ansari @ Muktar Ansari -Petitioner Mr. Arijit Ghosh ...for the Petitioner Mr. Abhijit Sarkar Mr. Bhaskar Das ...for the State Apprehending arrest in connection with Phansidewa Police Station Case No.358 of 2025 dated 07.08.2025 under Sections 318(4)/336(3)/340(2)/61(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023, the present application has been preferred. Mr. Ghosh, learned advocate appearing for the petitioner submits that all the offences alleged are bailable and no notice under Section 35(3) of the BNSS Act has been served upon the petitioner. He has been falsely implicated and his name also does not feature in the complaint.

In the said conspectus, custodial interrogation may not be necessary. Mr.

reveal that several transfers are being effected in a fraudulent manner.

He further submits that investigation is still continuing. Though notice was served upon the petitioner on 06th August, 2025 he has not met with the investigating officer. He further submits that the petitioner is also involved in another criminal case being Phansidewa Police Station Case No.293 of dated 3rd July, under Sections 318(4)/336(3)/340(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023. In the said conspectus, the petitioner's prayer needs to refused moreso when the investigation is still continuing. Heard the learned advocates appearing for the respective parties.

Considering the nature of accusations, the petitioner's antecedents and the gravity of the offences, I am not inclined to exercise any discretion in favour of the petitioner. Accordingly, the application being CRM (A) no.840 of 2025 is dismissed.
