1. The petitioners pray for anticipatory bail on the ground that two of the co-accused have already been granted bail and charge-sheet has been submitted.
2. The learned advocate for the State submits that in 2011, the victim was found missing and the sister of the victim lodged a complaint with the police alleging that the victim had gone with the petitioners to Kamakshya.
3. It appears that the victim has not yet been recovered, but chargesheet was submitted in 2015. Some co-accused persons are on bail.
4. Accordingly, we direct that in the event of arrest the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of equal amount each, to the satisfaction of the Additional Chief Judicial Magistrate, Dinhata, Cooch Behar and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The further condition is that the petitioners shall appear before the jurisdictional court on the
dates fixed. The petitioners shall not leave the jurisdiction of the jurisdictional court without permission of the court.
5. The application for anticipatory bail, being CRM (A) 869 of 2024 is, thus, disposed of.
6. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
