Apprehending arrest in connection with Kuchlibari Police Station Case no.120 of 2025 dated 27.08.2025 under Sections 223/303(2)/317(2) of the Bharatiya Nyaya Sanhita, 2023, the present application has been preferred.
Ms. Dutta, learned advocate appearing for the petitioner submits that a co-accused person, similarly situated with the petitioner, had already been granted anticipatory bail by a coordinate Bench of this Court on 27th November, 2025. In view thereof, the petitioner may be granted anticipatory bail on any condition.
Mr. Chakraborty, learned Additional Public Prosecutor appearing for the State opposes the petitioner's prayer and submits that investigation is not yet complete.
Heard the learned advocates appearing for the respective parties and considered the materials on record.
Prima facie, it appears that the extent of complicity of the petitioner herein is similar to that of one, Kalam Mandal @ Kamal Mandal @ Fakira, who had already been granted anticipatory bail. In view thereof and considering the nature of accusations and the extent of complicity of the petitioner in the alleged offence, I am of the opinion that his custodial interrogation is not necessary. Accordingly, I direct that in the event of arrest the petitioner, namely, Achhmat Pramanik @ Md. Ashmat Ali Pramanik shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, with further conditions that he shall meet with the Investigating Officer/Inspector-in-charge of the concerned police station once a fortnight until further orders, co-operate with the investigating officer and attend the learned trial Court on all the dates as fixed for appearance and hearing.
It is made clear that in the event the petitioner fails to comply with the aforesaid directions without any justifiable cause, the learned trial court would be at liberty to cancel his bail without any further reference to this Court.
The application for anticipatory bail, being CRM (A) 846 of 2025, is disposed of.
