Petitioner has challenged the proceedings arising out of Kalimpong Police Station case no. 79 of 2023 dated 16.06.2023. Record of the case reflects that charge-sheet no. 104/2023 dated 07.07.2023 has been filed before the jurisdictional Court. Having considered that the documents under Section 207 of the Code of Criminal Procedure have not been annexed and the contention advanced in the revisional application is in the nature of plea of alibi, I am not inclined to interfere at this stage. As none appears on behalf of the State Mr. Ujjwal Luksom, learned advocate who ordinarily appears for the State is directed to represent the State. His appointment may be regularized by the concerned authorities.

A copy of the revisional application be served upon the learned advocate for the State.

However, the petitioner would be at liberty to take out an appropriate application at the stage of consideration of charges if the learned Court till date has not framed the charges against the petitioner.

With the aforesaid observations CRR 533 of 2025 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
