Mr.
Banerjee, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. The other co-accused persons have already obtained bail and investigation is also complete. In view thereof, custodial interrogation of the petitioner may not be necessary. Mr. Bhattacharjee, learned advocate appearing for the State opposes such prayer and draws my attention to several documents in the case diary including the injury report. He further submits that the petitioner is absconding and warrant of arrest has already been issued.
Heard the learned advocates appearing for the respective parties.
Considering the injury report, the nature of accusations and the conduct of the petitioner, I am not inclined to exercise any discretion in favour of the petitioner.
Accordingly, the application being CRM (A) no.848 of 2025 is dismissed.
