The petitioners pray for anticipatory bail. The petitioners are the family members of the principal accused. The principal accused has been granted bail by the Juvenile Justice Board. Learned advocate for the State opposes the prayer of the petitioner.
Considering the case diary produced by the learned advocate for the State, we find that there are no specific allegations against the petitioners. The principal accused is already on bail. Hence, we are inclined to extend the benefit of anticipatory bail to the petitioners. Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of equal amount each, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973, corresponding
to Section 482(2) of the B.N.S.S. 2023. The petitioners shall also cooperate with the investigation.
In case the petitioners fail to adhere to any of the conditions stated above, the learned jurisdictional court shall be entitled to cancel the bail without further reference to this court. The application for anticipatory bail, thus, disposed of. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
