The petitioner has an outstanding loan with the UCO Bank, Dewa Guri Branch, District : Cooch Behar.

The said bank has initiated a proceeding under Section of the Securitization and Reconstruction of Financial assets and Enforcement of Security Interest Act, 2002 (SARFAESI) which is pending before the District Magistrate, Cooch Behar, the respondent no. 1 herein.

Mr. Debabrata Dhar, learned Advocate for the petitioner submits that his client is ready and willing to liquidate all the dues of the bank.

Mr. Deborshi Dhar, learned Advocate for the Bank submits that December 20,

2024 is the next date fixed in the said proceeding.

The petitioner, on the said date, is free to approach the respondent no. 1 for payment of his dues with the Bank, if such payment is made, the proceeding under the said Act of 2002 shall be disposed of accordingly.

WPA 2373 of 2024 is disposed of with the above terms without any order as to costs.

Since no affidavit has been invited, the allegations contained in the writ petition are deemed not to be admitted.
