Ks Sl 47 Calcutta High Court In The Circuit Bench at Jalpaiguri Appellate Side CRM(A) 867 of 2023 In re : An application for bail under Section 438 of the Code of Criminal Procedure, 1973 filed on 19.9.2023 in connection with Pundibari Police Station Case No. 40 of 2023 dated 20.01.2023 under Sections 498A/326/307 of the IPC and added Section 302/304B of the IPC.

Heard learned Advocates appearing for the parties. This is an application for anticipatory bail under Section 438 of the Cr.P.C. The case against the accused persons are under Sections 498A/326/307 and Sections 302/304B of the Indian Penal Code read with Sections 3/4 of the Dowry Prohibition Act, 1961. Considering the nature of offence and its seriousness and the manner in which the offence was allegedly committed, we are not inclined to grant bail to the accused/petitioners.

Accordingly the application being CRM (A) 867 of 2023 is rejected. (Partha Sarathi Chatterjee, J.) (Md. Nizamuddin, J.)
