The instant application is filed praying for quashing the Charge Sheet No. 167/2019 dated 14.3.20219 under Sections 341/323/509/34 of the Indian Penal Code, arising out of Bhaktinagar Police Station Case No. 11 of 2019 dated 05.01.2019 under the same sections. 2.
Mr. Mahasaya, Learned Counsel appearing for the petitioner submitted that this is a counterblast of another F.I.R. lodged by the present petitioner. 3.
The Learned Counsel for the de facto complainant submitted that both the complaints are unconnected. 4.
I have seen the C.D.

The Learned Public Prosecutor invited attention to the statement recorded under Section 161 of Cr.P.C. None of
the witnesses stated that the present prosecution or the present complaint is counterblast of the previous one. 6.
On perusal of C.D. and other materials, this Court is of the opinion that there are prima facie incriminating materials against the present petitioner for which it is not fit case to exercise extraordinary jurisdiction under Section 482 of Cr.P.C.

Accordingly, the instant application stands dismissed. C.D. be returned.
