This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by non-consideration of the representation dated 13.6.2022 made by the petitioner to the respondent No. 2. I have heard Counsel appearing on behalf of the petitioner and perused the materials placed on record. In my view, the District Inspector of Schools (SE), Cooch Behar, being the respondent No. 5 herein is directed to consider the representation of the petitioner after granting an opportunity of hearing to the petitioner and thereafter pass a reasoned order within six weeks from the date of communication of this order. The reasoned order is to be communicated to the petitioner within two weeks from the date of passing of the same.

With these observations, W.P.A. 3249 of 2022 is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
