And In the matter of: Jahangir Alam @ Rubel ....Petitioner Mr. Joydeep Kanta Bhowmik, Mr. Sayantan Bhowmik, Mr. Shubham Kumar, Ms. Sayantani Das ...for the Petitioner Mr. Nilay Chakraborty, Mr. Biswarup Roy ...for the State The petitioner prays for bail on the ground that he is languishing in custody for 67 days.

Learned Additional Public Prosecutor opposes such prayer and produces the case diary.

Considering the materials-on-record and the injury report, we are inclined to enlarge the petitioner on bail. Accordingly, we direct that the petitioner shall be released on bail upon furnishing a Bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Jalpaiguri. The petitioner shall meet the Investigating Officer of Dhupguri

Police Station once a week and shall not leave the jurisdiction of the Dhupguri Police Station.

In the event the petitioner fails to comply with the conditions as stated hereinbefore, it is open to the learned trial court to cancel the bail of the petitioner without any further reference to this Court.

The application for bail is, thus, allowed.
