And In Re: Sushanta Ray @ Uttam -Petitioner Mr. Anirban Banerjee, Mr. Soumyajit Laskar ...for the Petitioner Mr. Tapan Bhattacharya ...for the State Apprehending arrest in connection with Maynaguri Police Station Case No.533 of 2025 dated 17.10.2025 under Sections 126(2)/115(2)/74/109/304/3(5) of the Bharatiya Nyaya Sanhita, 2023, the present application has been preferred. Mr.

Banerjee, learned advocate appearing for the petitioner submits that the dispute was pertaining to an amount of loan of Rs. 2,00,000/- which the complainant alleged to have repaid. The petitioner has been implicated on the rudiments of false allegations. The complaint was also lodged about five days after the alleged incident. Co-accused persons have already been granted anticipatory bail by the learned Sessions Judge. In view thereof, the petitioner may be granted anticipatory bail on any condition.

Mr. Bhattacharya, learned advocate appearing for the State opposes the petitioner's prayer and draws the attention of

this Court to the statement of the witnesses as well as the injury reports.

Having heard the learned advocates and considering the materials on record, particularly, the injury report, the nature of accusations and the extent of complicity of the petitioner in the alleged offence, I am of the opinion that custodial interrogation of the petitioner is not necessary.

Accordingly, I direct that in the event of arrest the petitioner, namely, Sushanta Ray @ Uttam shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita with a further condition that the petitioner shall meet with the investigating officer once a week till the investigation is over.

The application for anticipatory bail, being CRM (A) 871 of 2025, is disposed of.
