The petitioner is claiming to have title over Plot No.55/8 of Ward No.46 of the Siliguri Municipal Corporation under P.S.- Pradhan Nagar, District - Darjeeling. The petitioner is alleging that the private respondent nos.6 and 7 are executing unauthorized construction over the said plot of land, and is praying intervention of the concerned authority into the matter. A representation of the petitioner to the said effect is pending consideration before the Commissioner, Siliguri Municipal Corporation, the respondent no.3 herein, the said representation dated July 08, 2024 forms part of the writ petition, being Annexure P-7.
The petitioner is praying disposal of the said representation.
The respondent no.3 is directed to consider and dispose of the said representation expeditiously in accordance with law, preferably within a period of six weeks from the date of communication of this order, if
necessary, after giving the representative of the petitioner and all other concerned parties an opportunity of hearing. WPA 2422 of 2024 is disposed of with the above terms without any order as to costs.
No affidavit since has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
