1. It is submitted by the learned advocate for the petitioner that other co-accused are enlarged on bail and he is innocent. He is behind the bar for 360 days.

2. It is further submitted that on the basis of statement of co-accused he has been made accused in respect of other case which is pending against him.

3. Learned prosecutor raises objection and submits that he has criminal antecedents and also he is engaged in inter state drug trafficking racket.

4. Having heard the submission of both the learned advocates and going through materials and submission advanced both learned advocates this Court is of the view

serious allegations against the petitioner and three other criminal cases are pending against him.

5. Therefore, this Court cannot have any reason to belief that the petitioner has been able to come out from the rigors of Section 37 of the NDPS Act.

6. Hence the prayer stands refused.

7. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.

8. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
