The petitioner is aggrieved by the rejection of the petitioner's application for transfer.
The impugned document of rejection simply states that the deceases mentioned by the petitioner are not in the concerned Government order.
The petitioner's case is that the school is 110 kms from the petitioner's present place of residence and that the petitioner's wife suffers from Bipolar Disorder. The petitioner has been working in the concerned school from 2017.
Upon hearing learned counsel, this court is of the view that the representation made by the petitioner on 9th November, 2022, which is after the impugned order of the rejection, may be considered by the appropriate authority which in the present case is the respondent no.4 being the Chairman, District Primary School Council, Cooch Behar.
The representation shall be considered and disposed of by passing a reasoned order by respondent no.4 within three weeks from today after hearing the petitioner and a copy of the reasoned order shall be made available to the petitioner within a week from the date on which such order is passed. WPA 3302 of 2022 is disposed of in terms of the above.
