The brother of the petitioner was a Lecturer in Darjeeling Polytechnic who had died- in-harness. The petitioner thereafter was appointed as Lower Division Clerk on compassionate ground and on attaining the age of superannuation, she had retired from her said service on December 31, 2023, but with a shortfall in qualifying service of 21⁄2 years to get the benefit of pension. The petitioner is praying condonation of the said shortfall in her service.
Mr. Bhandari, learned advocate for the petitioner submits that the said shortfall has been caused due to the delay in appointing her in the said post; as such, is condonable.
A representation of the petitioner to the said effect is pending consideration before the Director, Directorate of Technical Education and Training, Government of West Bengal, the respondent no.3 herein, the said representation dated April 02, 2024 forms part of the writ petition being Annexure-P/5.
The petitioner is praying disposal of the said representation.
The respondent no.3 is directed to consider and dispose of the said representation expeditiously in accordance with law, preferably within a period of six weeks from the date of communication of this order. WPA 2433 of 2024 is disposed of with the above terms without any order as to costs.
No affidavit since has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
