The petitioner has raised an issue with regard to use of Vehicle no.WB71B 8204 by Alipurduar Zilla Regulated Market Committee without following a regular tender process.

The petitioner submits that a sum of Rs.60,000/- only is being regularly paid in respect of this vehicle to the three partners who are running this vehicle. The petitioner suggests that the money is being siphoned off from the Alipurduar Zilla Regulated Market Committee in an illegal manner. The petitioner has filed a complaint before the District Magistrate and Chairman of the Market Committee. The same is pending consideration.

As it appears that the petitioner has raised an issue with regard to misuse of public fund and as the representation filed by the petitioner is pending consideration at the end of the District Magistrate, accordingly, the instant writ petition is disposed of by directing the District Magistrate, Alipurduar being the Chairman of the Alipurduar Zilla Regulated Market

Committee to consider the representation filed by the petitioner on 19th September, 2023 in accordance with law at the earliest, but positively within a period of six weeks from the date of communication of this order. The District Magistrate shall ensure that the allotment of vehicle is done in accordance with the provision of law. If any remedial measure is require to be taken, the same shall be taken by the District Magistrate forthwith. A reasoned order shall be passed and communicated to the petitioner.

Learned advocate for the petitioner is directed to forward a copy of the representation dated 14th September, 2023 received in the office of the District Magistrate, Alipurduar on 19th September, 2023 at the time of communicating the order of the Court. Writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
