Learned advocate appearing for the petitioners submits that the petitioners are in custody for 91⁄2 months and the recovery in this case was from joint possession of the petitioners and others to the tune of 21.94 kgs of ganja.
Learned advocate for the State opposes the prayer for bail and submits that one of the accused person is still absconding. Having considered the quantity of seizure, the period of detention of the present petitioners and that there is no scope of the trial commencing, I am of the opinion that further detention of the petitioners are unwarranted. Accordingly, the prayer for bail of the petitioners is allowed.
Consequently, the petitioners namely, Manik Chandra Barman, Biswajit Das and Papai Barman shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act-cum-learned Additional Sessions Judge, 1st Court, Cooch Behar. If on bail, the petitioners shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of district of Cooch Behar without the prior permission of the learned special court.
Accordingly, CRM (NDPS) 512 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
