The petitioners are in custody for more than 200 days and pray for bail.
Learned counsel for the petitioners submits that the exact quantum of the seized article is not reflected in the FIR and grounds of arrest have not been communicated to the petitioner in the language understood by him. Learned counsel for the State opposes the prayer. Contraband article exceeding commercial quantity has been recovered from the possession of the petitioners. Details
with regard to the quantum of the said article and also whether the petitioners were able to understand the grounds of arrest communicated to them shall be determined at the appropriate stage of the proceeding.
In view of the statutory restriction laid down under Section 37 of the NDPS Act, prayer for bail is rejected at this stage.
The application being CRM 516 of 2025 is, thus, disposed of.
