Mr. Sanjay Mazoomdar Ms. Sukanya Adhikary ...for the petitioner Mr. Hirak Barman Mr. Bikash Singh ...for the State The grievance of the petitioner is directed against inaction on the part of the Chairman, West Bengal Central School Service Commission being the respondent no. 3 in not disposing of the prayer for transfer of the petitioner.

The State is represented and submits that the contesting respondents are the respondent nos. 3 and 4 and they have no objection if the writ petition is disposed of by directing the respondent no. 3 to consider the request for transfer.

In view of the above, WPA 2510 of 2024 stands disposed of by directing the respondent no. 3 to consider the prayer for transfer dated August 24, 2024 within a period of six weeks from the date

of communication of this order and without being influenced by any observation made on the merits of the case and after giving a right of hearing on the affected party.

It is made clear that there has been no adjudication on the merits of the case. The respondent no. 3 is to act strictly in accordance with law.

All questions are left open to be decided in accordance with law.

The State is also directed to communicate this order to the respondent no. 3 forthwith. There shall, however, be no order as to costs. Since no affidavits have been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
