Learned advocate appearing for the petitioner submits that out of a civil dispute, a criminal case has been registered for investigation and even if the entirety in the complaint is accepted to be true out of a sum of Rs.13,00,000/- paid by the de facto complaint, a sum of Rs.7,00,000/- were refunded. For non-payment or nonrefund of Rs.6,00,000/-, the present case has been registered.

I have taken into account the accusations made in the letter of complaint dated 17.11.2025 which was addressed to
the Officer-in-Charge, Pradhan Nagar Police Station. On an assessment of the overall materials, I am of the view that custodial detention of the present petitioner is unwarranted in view of the nature of the accusations made. As such, the prayer for anticipatory bail of the petitioner is allowed. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the Investigating Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petitioner shall also make himself available as and when called for by the Investigating Officer. The application for anticipatory bail, being CRM(A) 907 of 2025, is, thus, disposed of.
