Arif Hossain v. The State Of West Bengal
06.01.2026
IN THE HIGH COURT AT CALCUTTA
Item No.20 CIRCUIT BENCH AT JALPAIGURI Ct.No.3 dc.
Rejected C.R.M. (A) 912 of 2025 In Re : An Application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Pundibari Police Station Case No. 583 of 2025 dated 27.06.2025 under Sections 85/123/109 of the Bharatiya Nyaya Sanhita, 2023.
And In Re :
Arif Hossain ... Petitioner.
Mr. Hillol Saha Podder ... For the Petitioner.
Mr. Ujjwal Luksom, Ms. Namrata Das ... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is the husband and is similarly situated as other accused persons who have been granted anticipatory bail. It has been submitted that there was a normal marital dispute wherein the victim alleged that she was forcefully administered poison. Such allegation is similarly placed as other accused persons who have been extended the privilege of anticipatory bail.
Learned advocate appearing for the State has produced the case diary.
I have taken into account the statement of the victim and I am of the opinion that this is not a fit case for extending the privilege of anticipatory bail to the present
petitioner. As such, the prayer for anticipatory bail of the petitioner is rejected.
The application for anticipatory bail, being CRM (A) 912 of 2025, is, thus, dismissed.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
