1. The affidavit of service filed in court is taken on record.
2. None appears for the District Primary School Council.
3. State is represented.
4. The petitioner prayed for transfer on the ground that the present school where she is working is at a distance of 52 kms. from her residence. She also submits that she is a surplus teacher in the school and her services can be spared. The application is pending consideration before the Chairman, District Primary School Council, Cooch Behar.
5. Without entering into the merits of the said application, the instant writ petition is disposed of by directing the Chairman, DPSC, Cooch Behar to consider the prayer of the petitioner in accordance with law, at the earliest, but positively within a
period of ninety days from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.
6. Learned advocate for the petitioner is directed to forward a copy of the application seeking transfer along with all documents in support of his prayer to the aforesaid respondent at the time of communicating the order of the court.
7. Accordingly the writ petition is disposed of.
8. There shall be no order as to costs.
