Case No.466 of 2023 dated 8.9.2023 under Sections 406/420/34 of the Indian Penal Code.

Heard learned Advocates appearing for the parties. This is an application for bail under Section 439 of the Cr. P.C.. Learned Advocate appearing for the petitioners submits that bail has already been granted to another co-accused person by the order of this court dated 13th October, 2023 in CRM(DB) 634/2023(Renuka Parvin) and the present petitioners are standing on the same footings. Learned Advocate representing the State does not deny that the present petitioners are standing on the same footings as of another coaccused person who has already been granted bail. We have perused the records including the Case Diary and considered the submission of the parties.

We are of the considered view that in the facts and circumstances of the case further detention of the present petitioners will not serve any

purpose. In view thereof, present petitioners may find bail upon furnishing a bond of Rs.5,000/-(Rupees Five Thousand only) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Ld. CJM, Jalpaiguri subject to the condition that the petitioners shall cooperate with the Investigating Officer and shall not leave the jurisdiction of the local Police Station without the leave of the concerned court. CRM 637 of 2023 is disposed of.
