Learned advocate appearing for the petitioners have challenged the continuance of the proceedings arising out of Bhaktinagar Police Station Case No.
of corresponding to Special Case No. 04 of 2017 pending before the learned Additional District and Sessions Judge and Special Court {under SC & ST (POA)} Act, 1989. However, on perusal of the records, it reflects that on 04.09.2025 a discharge petition was preferred before the learned Special Court in connection with the aforesaid case. Learned advocates for the State and the private respondents are present.
As the discharge petition is pending before the learned Special Court, the petitioners would be at liberty to take up all the issues canvassed in the present revisional application at the time of hearing of the discharge petition. Learned Special Court would pass necessary orders without being influenced by any observations passed by this Court.
With the aforesaid observations, the revisional application being CRR 570 of 2025 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
