Ms. Chatterjee, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. His name has transpired on the basis of coaccused's statement and in view thereof, custodial interrogation may not be necessary.

Mr. Bhattacharjee, learned advocate appearing for the State has placed before this Court the case diary including the statement of the witnesses.

Answering the query of this Court, he submits that investigation is still continuing and the co-accused persons have already been granted regular bail.

Having heard the learned advocates and considering the gravity of the offence, the nature of accusations and the extent of complicity of the petitioner in the alleged offence, I am not inclined to exercise discretion in his favour more so when investigation is still continuing.

Accordingly, the application for anticipatory bail, being CRM (A) 923 of 2025, is dismissed.
