And In Re: Sri Pankaj Kumar Ray -Petitioner Mr. Dipankar Ray ...for the Petitioner Mr. Tapan Bhattacharjee, Mr. Chattu Roy ...for the State Mr. Arijit Ghosh ....for the de facto complainant Affidavit-of-service, as filed, be kept on record. Apprehending arrest in connection with Bhaktinagar Police Station Case No.884 of 2025 dated 02.09.2025 under Sections 69/89/318(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023, the present application has been preferred. Mr. Ray, learned advocate appearing for the petitioner submits that a false complaint was lodged against the petitioner alleging inter alia, that he had committed sexual assault upon the victim on false promise of marriage. It has also been alleged that a sum of money which was handed over to the petitioner had not been returned though the documents annexed to the petition would reveal that such allegation is absolutely unfounded. Upon completion of investigation chargesheet has

also been filed and as such custodial interrogation may not be necessary.

Mr. Bhattacharjee, learned advocate appearing for the State opposes the petitioner's prayer and draws my attention to several documents in the case diary including the statement of the complainant registered under Section 183 of BNSS. Heard the learned advocates appearing for the respective parties.

Considering the statements made by the complainant under Section 183 of BNSS, the nature of accusations, the severity of the offence and the extent of complicity of the petitioner, I am not inclined to exercise any discretion in favour of the petitioner.

Accordingly, the application being CRM (A) no.924 of 2025 is dismissed.
