Apprehending arrest in connection with Jaigaon Police Station Case no.104 of 2025 dated 24.05.2025 under Sections 126(2)/103(1)/61(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023, the present application has been preferred.

Mr. Guha, learned advocate appearing for the petitioners submits that the petitioner no.1 is aged about 65 years and the petitioner no.2 is aged about 21 years having a minor son of three years. They have been falsely implicated. No specified overt act has been attributed to the petitioners. Upon completion of investigation chargesheet has also been submitted and as there is no possibility that the petitioners would flee from justice, they may be granted anticipatory bail on any condition. Mr. Roy, learned advocate appearing for the State opposes the petitioners' prayer and draws the attention of this Court to the statement of the witnesses, as recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023. He further submits

that as there are strong incriminating materials on record, the petitioners' prayer may be refused.

Heard the learned advocates appearing for the respective parties. Considering the gravity of the offence, the nature of accusations and the extent of complicity of the petitioners in the alleged offence, I am not inclined to exercise discretion in their favour.

The application for anticipatory bail, being CRM (A)927 of 2025, accordingly, is dismissed.
