The application filed by the petitioner for obtaining FPS Dealership vide FPS Vacancy Notice bearing Memo No. 131/SCFS/SLG/2023 dated February 6, 2023 stood rejected. The petitioner is aggrieved by the same. The petitioner claims that he is the most eligible candidate for being awarded the dealership. The respondent authorities illegally and arbitrarily accepted the offer of the private respondent.

None represents the private respondent.

Affidavit of service filed in Court today is taken on record.

Learned advocate representing the State respondents submits, upon instruction that, there are various grounds on which the application filed by the petitioner stood rejected.

The respondent no. 2 being the Sub-Divisional Controller of Food & Supplies, Siliguri is directed to formally communicate the reason(s) for rejecting the

application filed by the petitioner positively by one week. A copy of the instruction forwarded by the aforesaid respondent to the learned advocate for the State has, however, been handed over to the learned advocate representing the petitioner in Court today.

It will be open for the petitioner to take necessary steps after receiving the communication from the aforesaid respondent, if permissible in law.

The writ petition stands disposed.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
