Considering the report of the Sub-Divisional Land and Land Reforms Officer, Mathabhanga dated November 28, 2023, the authorities are directed to immediately release Rs.33,480/- to the petitioners as per their entitlement.
It appears that the composite amount of Rs.33,480/- is payable from March 15, 2016 to September 21, 2016, that is for a period of six months six days. However, the report does not indicate Biplab's and Sahadeb's share. Thus, the authority shall disburse the money according to their eligibility or in equal proportion, as the authority deems fit. Such payment shall mandatorily be made within 10 days from date.
With regard to the remaining unpaid dues, each of the petitioners are granted liberty to file separate representations before the concerned offices in which they had supplied the generators, along with supporting documents. The said representations shall be disposed of within a period of four weeks from date of receipt of the same, upon granting a hearing to the petitioners and the authority who was involved in the process.
Accordingly, the writ petition is disposed of. CAN 1 of 2023 is also disposed of, granting similar liberty to the applicant who sought to be added as a party in this proceeding, to approach the authority in accordance with this order, seeking payment of his alleged dues.
However, there shall be no order as to costs. All the parties are directed to act on the basis of the server copy of this order.
