Pursuant to the earlier direction dated 10.01.2025 Item No.1 kausik 07.01.2025 all the 15 (Fifteen) accused persons who are on bail are present before this court and are identified by the Investigating Officer of the case. The 15 (Fifteen) accused persons are directed to appear before the jurisdictional court being the learned ACJM, Dinhata on 13.01.2025.
The documents relied upon by the prosecution under section 207 of the Code of Criminal Procedure are handed over by the learned advocate appearing for the state to each of the 15 (Fifteen) accused persons. An acknowledgement to that effect is made on a separate sheet of paper which the Investigating Officer will furnish before the learned ACJM, Dinhata on 13.01.2025.
The learned ACJM, Dinhata would split up the case in respect of the absconding accused persons
and commit the case to the learned Sessions Court for further progress of the case in accordance with law. With the aforesaid observations WPA 2517 of 2023 is disposed of.
Pending applications, if any, be consequently disposed of.
The Investigating Officer is personally present in court along with the 15 (Fifteen) accused persons. Their further presence before this court is dispensed with.
All the accused must ensure their presence before the learned ACJM, Dinhata on 13.01.2025. In the alternative the learned Magistrate would cancel the bail.
Report so submitted be kept with the record.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
