This application under Article 227 of the Constitution of India is by the petitioner/husband seeking an expeditious time bound disposal of the Matrimonial Suit No. 119 of 2020, now pending in the Court of learned Additional District Judge, 2nd Court at Siliguri.

It is learnt that the petitioner is yet to pay the arrear amount of maintenance pendente lite, which is, however, not computed as yet. An execution case is pending in the trial court being Misc. Execution Case No. 1 of 2025.

In view of the facts and circumstances of the case and considering the submissions of the respective parties, it is found proper to dispose of this application by directing the trial court to

dispose of the Matrimonial Suit No. 119 of 2020 in a time bound manner, positively within a period of six months from the date of communication of copy of this order to the same, subject to the fact that the arrear amount of alimony pendente lite be paid by the petitioner as a condition precedent for taking up the matrimonial suit for final disposal by the Court. With the above directions, the C.O. 209 of 2024 is disposed of.
