The decision of the Siliguri Municipal Corporation dated 28th July, 2023 rejecting the prayer of the petitioner to accord sanction to the revised building plan is placed on record.

The resolution rejecting the prayer of the petitioner gives rise to a fresh cause of action. Since the petitioner is aggrieved by the same, it will be open for the petitioner to challenge the same in an appropriate proceeding.

There is no requirement of proceeding with the contempt application any further.

Contempt application stands disposed of.

The writ petition be sent back to the Circuit Bench at Jalpaiguri by Special Messenger upon payment of cost by the petitioner.
